Purpose of Meeting: A Temporary Use By-Law application was received for the subject property municipally known as 3362 Manning Rd and legally described as Part of the North half of Lot 1, Concession North of Middle Road, Maidstone, designated as Part 1 on Plan 12R15753. The subject property is designated “Agricultural” in the Lakeshore Official Plan and is zoned “Agricultural (A)” under the Lakeshore Zoning By-law 2-2012.
The intent of the Temporary Use By-Law is to legalize an existing non-conforming home industry in an accessory structure for a small-scale automobile repair business and to allow for operations to continue for a maximum period of 3 years. After the Temporary Use-By-Law expires, there is a possibility for a further time extension through a subsequent application. The Temporary Use By-Law includes site-specific exemptions from Section 6.26 of the Lakeshore Zoning as it relates to a Home Industry.
For the proposed Temporary Use By-Law Council will consider an amendment to Lakeshore Zoning By-law 2-2012, as amended (File: ZBA-16-2024), under Section 34 of the Planning Act, R.S.O.1990, c.P.13.
This item was initially scheduled to be on the October 1, 2024 Council Agenda. The is now going to be heard at the October 22, 2024 Council meeting instead.
Council Meeting Date: Tuesday, October 22, 2024, at 6:00 p.m. or as practical thereafter.
Meeting Location: Hybrid meeting with limited in-person attendance at Town Hall, 419 Notre Dame Street, Belle River or by joining online at Lakeshore.ca/Tv

Right to Appeal: If a person or public body would otherwise have an ability to appeal the decision of the Municipality of Lakeshore to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Municipal Clerk of the Municipality of Lakeshore before the proposed Zoning By-law Amendment is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Municipal Clerk of the Municipality of Lakeshore before the proposed Zoning By-law Amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
