E-bike and E-Scooter Enforcement in the County

Over the next few weeks, members of the Essex County Detachment of the Ontario Provincial Police (OPP) and by-law officers from the various communities will be out educating the public of the rules and regulations governing e-bikes and e-scooters in the county. 

As the use of these vehicles continues to grow across the county, it is important for riders to recognize that e-bikes-also known as power-assisted bicycles-are subject to Ontario's Highway Traffic Act and Ontario Regulation 369/09.

Electric-powered motorcycles and dirt bikes are treated the same as their gas-powered counterparts under Ontario law.

To be legally operated, an e-bike must meet the following requirements:

• Be equipped with operable pedals
• Have an electric motor rated at 500 watts or less
• Have a maximum assisted speed of 32 km/h
• Weigh no more than 120 kg, including the battery
• Be equipped with two independent braking systems
• Have the battery and motor securely fastened to the frame
• Have all electrical terminals properly insulated
• Meet all Ontario equipment standards

E-bike riders must also:

• Be at least 16 years of age
• Wear an approved bicycle or motorcycle helmet
• Follow the same rules of the road as cyclists
• Refrain from riding on controlled-access highways

Police are seeing several people, including children under the age of 16 years operating battery-powered scooters (e-scooters) in our communities.

Two-wheeled electric scooters are becoming very popular, especially with the younger segment of our population. E-scooters are reasonably priced, portable, and fun to ride.

The problem is that many people do not know what laws and restrictions apply to them.

To be legally operated, an e-scooters must have:

• Two wheels (one on front, one on back)
• Platform for standing
• Have an electric motor rated at 500 watts or less
• Have a maximum assisted speed of 24 km/h
• A handlebar for steering
• A braking system
• Horn or bell
• At least one white light on front, one red light on rear and reflective material on sides

E-scooters must not have:

• Pedals
• A seat
• A basket
• Any motor modifications

E-scooter riders must also:

• Be at least 16 years of age
• Wear an approved bicycle or motorcycle helmet if under the age of 18
• Always stand while riding

E-scooter riders must not:

• Carry passengers
• Carry cargo
• Park in areas designated for vehicles or pedestrians
• Operate on controlled access highways

In Ontario, riders should be aware that municipalities may have additional bylaws or restrictions in place that limit where e-bikes and e-scooters can be used, including on certain pathways, trails, or waterfront areas. Always watch for posted signage and follow local regulations.

Most municipalities DO NOT allow them on their roadways, sidewalks, trails, and parks. Generally, some are only allowed to be operated on private property. Check with your local municipality specific information in your area.

Unlike motor vehicles, operators are not required to have a driver's licence, vehicle registration, licence plates, or insurance.

OPP encourages all riders to prioritize safety, remain aware of their surroundings, and respect the rules of the road.
