The Committee of Adjustment was appointed by Council to hold hearings under the Planning Act with respect to minor variances, consents, enlargements, extensions or changes to legal non-conforming uses; consent to mortgages, partial discharge of mortgages, validation of title, access right-of-ways, easement and leases over 21 years.
Minor Variance
A minor variance allows a property owner to vary from a specific requirement of the Zoning Bylaw before obtaining a building permit. The committee is authorized to grant a minor variance if in the opinion of the committee the request satisfies every one of the four tests outlined in the Planning Act:
- Is the request minor in nature?
- Is the request desirable for the appropriate development of the lands?
- Does the request maintain the general intent and purpose of the Official Plan?
- Does the request maintain the general intent and purpose of the Zoning By-law?
Consents
A consent is the authorization to create new lots (land severance), permanent easements, add to an existing lot, adjust lot boundaries, enter into a mortgage or lease in excess of 21 years, and validate title. The Municipality of Lakeshore Official Plan has specific policies and requirements for consents. If your proposal involves creating more than a lot or two, it may be more appropriate to submit a Plan of Subdivision.
